&#60;p&#62;In that other post Grinner called it about 'getting a permit'. Technically, if it's a news event (i.e. a protest etc.) you generally don't need one. In your case the venue being a market of some sort, it would be best if you get written permission from the flea market organizers to shoot there. Yes, there are tons of general releases you can use for on-camera interviews, but in a pinch ask the person to be interviewed (while recording) if they would like to participate if they say no, move on. Persons in your b-roll crowd shots don't require releases unless you focus on a particular individual and identify them specifically.&#60;/p&#62;</description>

&#60;p&#62;That was from a Brit though and I would rather hear from someone in the US.  I am editing a documentary (I did not shoot) that we are working to get aired on PBS.  I need some additional B roll footage to break up the interviews.  We plan to shoot in a local open air market (read flea market).  As there any kind of release that needs to be signed by the location or the people appearing on screen?  I know someone out there has some experience with this sort of thing.  (No audio would be used from this shot, at least not of any copyrighted music, maybe some ambient sound).&#60;/p&#62;</description>

&#60;p&#62;reply and cc the client about the issue, informing them you intend to deliver as per the contract and agreements and give a quote on the costs to re-edit, re-shoot or otherwise re-do the project and inform them you expect to be paid for whatever changes they want at this point and suggest they work it out between themselves as far as who is responsible to pay you for what.&#60;/p&#62;
&#60;p&#62;The prospect of a legal fight or having to pay costs may be enough to deter them from pursuing the matter further.&#60;/p&#62;
&#60;p&#62;I'm assuming the talent is pertinent to the production, as I personally NEVER have anybody or anything in the picture on a commercial project, that isn't pertinent, in the first place.&#60;/p&#62;

<description>&#60;p&#62;First: You really need to acquire the advice of licensed legal counsel. You'll get opinions here, unless of course one of us is a licensed legal attorney - could be, but then he/she wouldn't likely be willing to give you FREE advice beyond a short &#34;consultation&#34;.&#60;/p&#62;
&#60;p&#62;Second: The way things have been for a long, long time just about anybody can sue anybody for anything. It might get thrown out as frivolous or otherwise &#34;go away&#34; but the act of litigation itself is going to cost SOMEBODY money, and both parties some of their precious time.&#60;/p&#62;
&#60;p&#62;That being said: It is MY personal experience regarding this (and it has happened to me a time or two) that unless the talent is a MUST INCLUDE part of a production, a deal-breaker as far as completing the project, then after consulting with the primary client (the one who's signature is on the contract/agreement) to get their take (and suggestions from their legal advisors) my approach is to let the rabbit go - don't want or need the potential future problems.&#60;/p&#62;
&#60;p&#62;If the talent's inclusion is CRUCIAL to the production, and he/she has been properly treated and compensated according to the release and/or any written or witnessed agreement between talent and your client, then that can be a problem both ways but you probably are covered and the &#34;talent&#34; is held by the short hairs. I say this because if all is proper between talent my CLIENT has acquired an agreement with, and if the talent has requested release from his/her signed release to either of us in writing, backed by an attorney and injunction or other papers filed in court - all things considered the signed release is probably binding.&#60;/p&#62;
&#60;p&#62;Talent can, however, make a LOT of claims in a suit, frivolous or otherwise, that can slam the production doors shut until all questions are decided upon between counsel or in a court of law - potentially years, my friend.&#60;/p&#62;
&#60;p&#62;YOU, however, might have an agreement/contract such that if any of this unpleasantry arises either your client, or the talent, will be in breach of contract. That, also, sad to say, usually winds up being decided in a court o law.&#60;/p&#62;
&#60;p&#62;So, we're back to square one - is inclusion of the &#34;talent&#34; critical to the production? If not, shake 'em loose. If they are critical to the production then, notification by e-mail, phone or in writing aside, it will likely still become an expensive, time-consuming matter taking years and requiring a court decision or legal compromise between counsel and parties involved.&#60;/p&#62;

The main talent (one individual) has decided to not be in the final edited production. This one person (talent) did sign a talent release form giving their permission that the footage would be used in the final edited production. Update: The talent notified me via phone and email that they did not want to be in the final edited production. &#60;/p&#62;
&#60;p&#62;&#60;strong&#62;Question&#60;/strong&#62;: What is my legal duty to honor his wishes to not be in the final edited video? Can I be sued as a production company if I knowingly still keep him in the final production even though he wrote to me and made it clear that he does not want to be in the final edited production? Do the laws vary from state to state or are they federal laws, etc? Note: The said talent did sign and date a talent release form. I have read that the talent release is not always written in stone and that the talent can always ask to be edited out at anytime - perhaps if I refuse to honor his wishes he can sue me and the client?&#60;/p&#62;

&#60;p&#62;Be careful out there. You are rolling the dice when travelling or engaging with the homeless/mentally ill. I consider myself fortunate to have such a vast background in hanging with mentally-challenged people. When I was a kid, my Mom drove all the special ed kids to school and that meant my riding with em. This, by default, made me their protectyor on the playground as school yard kids can be veeeery abusive to special needs children. I also had a little brother that had severe brain dammage and passed away when I was very  young. As a result of these experiences, you'll never see me laugh at retardation but, brother, you'll never see me insult someone with a retardation by pittying them either. IN a nutshell, this is why Beatle Bob and I bonded so well. Some hate him. Some laugh at him. I envy him. We should all be so lucky.&#60;/p&#62;

<description>&#60;p&#62;I think you'd serve these people better by hiring them as consultants for scriptwriting, method actors to build authenticity into your project. Pay them for thier input, then re-create with actors.&#60;/p&#62;
&#60;p&#62;I've mentioned before that I was a homeless person, as a teen.&#60;/p&#62;
&#60;p&#62;I assure you, While both my family, and Child and Family Services had no issues with abusing me or throwing me out on the street like I was garbage.....&#60;/p&#62;
&#60;p&#62;If you had filmed my story then, with me being under eighteen, CFS would've been suing you or charging you for something to cover up thier horrendous treatment of me, and the same family that tossed me out with the trash would have shown up with hands out or lawers looking for a paycheck.&#60;/p&#62;
&#60;p&#62;Then there is the mentally ill not fit to make descisions that come back later looking for something. &#60;/p&#62;
&#60;p&#62;You want to do a news reportage of a situation, you report it, you're covered legally... for the most part.&#60;/p&#62;
&#60;p&#62;You want to do a documentary, hire a lawyer to close up the loopholes first or you could wind up losing alot of money.&#60;/p&#62;</description>

&#60;p&#62;I have been helping serve some of the homeless and street folks in Ottawa, Canada, for a number of years and I too have a desire to do some kind of documentary that would be of benefit to them and others. I'll be following this thread.&#60;/p&#62;

<description>&#60;p&#62;My son is autistic and my husband and I are his legal guardians.  This is meant to protect him.  Keep in mind, even if he gave his consent for you to film him, his consent is null and void without the consent of his guardians.  The problem is, our son doesn't even understand that he can't make the decision.&#60;/p&#62;
&#60;p&#62;Most mentally ill people have guardians.  Talk to his caretakers and they should be able to point you in the correct direction.&#60;/p&#62;</description>

I went on a road trip with the infamous Beatle Bob. I knew he was homeless and assumed he was autistic. I wound up with a 90 minute feature and nobody in it, including the music legends sprinkled throughout cared about release forms. I hate em. I shoot reality. You can't get that after having folks sign a legal document. It's much easier for me to submit it to them for their approval first and nine times out of ten, that leads to gigs for them directly.&#60;br /&#62;

<description>&#60;p&#62;Â When I have interviewed &#34;street people&#34; in the past (never really developed into the documentary I wanted it to be) I usually only asked them to give me a verbal acceptance on tape (with or without their names - sometimes it was really challenging to get them to share their names/ages. Also most of them either mumble, speak very low, while the others yell, gesture and speak extremely loud and somewhat disconnected/incoherent, not always making much sense)&#60;/p&#62;
&#60;p&#62;Out of a few dozen &#34;interviews&#34; (the term used somewhat lightly), only one was willing to write/sign anything for me.&#60;/p&#62;
&#60;p&#62;Good luck with your efforts, it can be challenging but can also result in something very powerful. I hope you get from it what you are looking for. Keep us posted, if you will.&#60;/p&#62;</description>
